The Court of Appeal has today granted permission to appeal in the case of FK v Secretary of State for Justice. Mr K, represented by Carl Miles of Burton Copeland solicitors, is a post-tariff IPP prisoner who is challenging the failure by the Secretary of State to provide him with the appropriate courses which will enable him to demonstrate a reduction in risk when his case for release is considered by the Parole Board.

The case will be joined with another appeal with similar issues and is likely to be heard in November 2013. The case will potentially have far-reaching consequences for IPP prisoners who may find themselves in similar position to Mr K and who may wish to bring a case for Judicial Review against the Government.
