Rape

section 1 sexual offences act 2003

We understand that the consequences of an allegation of this nature can be frightening and life changing, if you are in this situation you need a lawyer who is specialist in defending these types of allegations and is proactive in ensuring a thorough background investigation takes place and that there is effective cross examination of the accuser.

The offence of rape is serious, it will be dealt with in the Crown Court and carries a maximum sentence of life imprisonment.

legal definition of rape

Rape simply defined is the intentional penile penetration of the vagina, anus or mouth of another, without consent or a reasonable belief that the other consents. Drunkenness is not a defence to rape.

Evidence

The opinion of some is that rape cases are often difficult to prove as the evidence is often limited to the alleged victims word against that of the accused, the issue usually is whether there was consent or not.

A Judge will tell a jury when summing up the case that if there is doubt, you should return a not guilty verdict. Imagine you were on the jury; there are two versions, consent and non-consent, would you not decide the case simply on which of the two versions you believed?

It is therefore essential that a thorough investigation takes place by the defence and any doubt is emphasised to the Court.

Analysis of background information

We will ensure that we obtain all relevant unused material from the prosecution and any other evidence from other sources. A careful analysis will take place to ensure that any inconsistencies are put to the witness/s in cross examination and information which assists or substantiates the defence is clearly highlighted to the jury.

In many cases we have supplied crucial information to the Court and Prosecution Lawyers resulting in the cases being stopped before a trial date was reached.
